By participating, you acknowledge and accept the terms of this waiver and are encouraged to listen to your body and move at your own pace.
CALGARY OUTDOOR YOGA – WAIVER & RELEASE OF LIABILITY
Calgary Outdoor Yoga values the health and safety of all participants. By signing this waiver, I acknowledge and agree to the following:
This waiver applies to all current and future participation in Calgary Outdoor Yoga classes and events.
1. DEFINITIONS
For the purposes of this agreement, “Calgary Outdoor Yoga” includes 2795968 Alberta Ltd., operating as Calgary Outdoor Yoga and Mahogany Outdoor Yoga, and includes its owner Krystal Scott, as well as all directors, officers, employees, contractors, instructors, volunteers, assistants, demonstrators, agents, representatives, sponsors, partners, and any venues or locations where activities take place (collectively referred to as the “Released Parties”).
2. ASSUMPTION OF RISK
I understand that participation in yoga, fitness, and wellness activities involves inherent risks that may result in injury, illness, death, or property damage.
These risks include, but are not limited to:
Physical exertion, strain, or overuse injuries
Slips, trips, and falls
Uneven terrain including grass, dirt, pavement, rocks, or natural surfaces
Weather conditions including heat, cold, wind, sun exposure, rain, or poor air quality
Falling objects such as tree branches or environmental hazards
Interaction with other participants, members of the public, children, or animals (including dogs)
Equipment failure or misuse
Limited access to immediate medical assistance
Additional hazards present in indoor and outdoor environments, including but not limited to slippery surfaces, spills, debris, glass, obstacles, furniture, or other conditions of the space.
I voluntarily accept and assume all risks, both known and unknown.
3. PARTICIPANT RESPONSIBILITY
I agree to:
Listen to my body and participate at my own pace
Stop immediately if I experience pain, dizziness, or discomfort
Inform the instructor of any injuries, limitations, or medical conditions
Follow all instructions provided by instructors and staff
I understand that failure to follow instructions or unsafe behavior may result in removal from class or event without refund.
4. MEDICAL ACKNOWLEDGMENT
I confirm that I am physically able to participate in these activities. I understand that yoga is not a substitute for medical advice, diagnosis, or treatment.
I acknowledge that:
I am responsible for consulting a physician if needed
No medical advice is being provided
Participation is entirely at my own risk
5. RELEASE OF LIABILITY
I hereby irrevocably release, waive, and discharge the Released Parties from any and all claims, demands, damages, actions, or causes of action arising out of or related to my participation, attendance at events, or use of any products or equipment provided or sold, to the fullest extent permitted by the laws of Alberta, including any claims arising from negligence.
6. INDEMNIFICATION
I agree to indemnify and hold harmless the Released Parties from any and all claims, damages, liabilities, or expenses (including legal fees) arising from:
7. VENUE & THIRD-PARTY LOCATIONS
I understand that classes and events may take place in public parks, outdoor spaces, private venues, or third-party locations.
I acknowledge that the Released Parties are not responsible for the condition, safety, or maintenance of these locations.
8. PHOTOGRAPHY & MEDIA CONSENT
I grant permission to Calgary Outdoor Yoga and the Released Parties to photograph, film, or record me and use this content for:
I understand:
No compensation will be provided
Classes and events may occur in public spaces where others may take photos or videos
I release any claims related to the use of my image or likeness
9. EMERGENCY MEDICAL CONSENT
In the event of an emergency, I authorize Calgary Outdoor Yoga to obtain medical treatment on my behalf.
I accept full responsibility for any associated costs.
10. PRODUCTS & EQUIPMENT
I understand that Calgary Outdoor Yoga may sell or provide products including, but not limited to, yoga mats, bolsters, blocks, apparel, and other wellness-related items.
I acknowledge that:
Use of these products carries inherent risks, including slips, falls, or injury
I am responsible for inspecting any product before use and ensuring it is suitable for my needs
I am using all products at my own risk
To the fullest extent permitted by law, I release the Released Parties from any liability arising from:
The use or misuse of any products
Any defects, malfunctions, or failure of products
Any injury or damage resulting from purchased or borrowed equipment
All products are provided or sold “as is” without warranties, except where required by law.
I understand that some products may be manufactured by third parties and Calgary Outdoor Yoga is not responsible for manufacturing defects.
11. MINOR PARTICIPANT AGREEMENT (UNDER 18)
If signing on behalf of a minor:
I confirm that I am the parent or legal guardian of the minor participant.
I:
Consent to their participation
Accept all risks on their behalf
Agree to all terms of this waiver
Confirm they are physically able to participate
Agree to indemnify and hold harmless the Released Parties from any claims involving the minor
12. LEGAL TERMS
This agreement:
Is governed by the laws of the Province of Alberta
Applies to all current and future participation in classes, events, and activities with Calgary Outdoor Yoga, including all locations, formats, instructors, and use of products, unless replaced by a newer version of this agreement
Remains in effect indefinitely
If any portion of this agreement is found to be unenforceable, the remaining provisions remain in full effect.
13. ACKNOWLEDGMENT
I confirm that:
I have read and understand this agreement
I am signing voluntarily
I understand I am giving up legal rights
I am the parent or legal guardian of the minor listed above (if applicable) and agree to this waiver on their behalf
